Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Ontario Fresh & Tasty website and customer account at FreshAndTasty.ca (the "Service"), operated by Ontario Fresh & Tasty Inc. ("we," "us," or "our"), 99 Advance Rd., Toronto, Ontario M8Z 2S6, Canada.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Access and Accounts

Account Registration

Access to the Service requires registration and email verification. You must provide accurate and complete information during registration and keep your account details current. You are responsible for maintaining the confidentiality of your password. To protect against automated abuse, our sign-in, registration, and password-reset forms use Cloudflare Turnstile, a bot-detection service.

Account Suspension

We reserve the right to disable or terminate your account at any time if we determine, in our sole discretion, that you have violated these Terms or that access should otherwise be restricted.

2. Permitted Use

The Service is intended for authorized customers of Ontario Fresh & Tasty. You agree to use the Service only for its intended purposes and in compliance with all applicable laws.

You must not:

  • Share your login credentials with any other person
  • Attempt to access accounts, data, or systems you are not authorized to access
  • Reverse-engineer, scrape, or otherwise extract data from the Service in an unauthorized manner
  • Use the Service to transmit malicious code or interfere with its operation
  • Use the Service for any unlawful purpose

3. Contact Form

The public contact form may be used to submit legitimate business inquiries. To reduce spam and automated submissions, the form is protected by Cloudflare Turnstile. We reserve the right not to respond to inquiries that are abusive, unsolicited commercial communications, or otherwise inappropriate. Submission of a contact form does not create any contractual relationship.

4. Intellectual Property

All content, software, and materials on the Service are the property of Ontario Fresh & Tasty Inc. or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during the term of your authorized access. No other rights are granted.

5. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

6. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Ontario Fresh & Tasty Inc. and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.

9. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
